TERMS AND CONDITIONS OF SALE
Any online purchase made on the website https://iminnocente.com is subject to prior acknowledgment and acceptance of these general terms and conditions of sale.

DEFINITIONS

Article: Products of any kind offered for sale (e-commerce service) on the Website.
Customer: A non-trading natural person placing the Order and having full legal capacity.
Order: The purchase commitment of all the Articles selected by the Customer via the Website's e-commerce service.
Website: The website operated by IM INNOCENTE and accessible at the following address:

PREAMBLE

These general terms and conditions of sale (hereinafter referred to as "T&Cs") apply exclusively between any Customer and IM INNOCENTE, registered under SIRET number 84766854800013, represented by MJV CREATION (hereinafter referred to as "IM INNOCENTE").

Any internet user can review the T&Cs from any page of the Website.
The T&Cs apply without restriction or reservation to all Articles offered for sale on the Website.
Any Order placed on the Website is subject to the prior consultation and unreserved acceptance by the Customer of these T&Cs and applicable rates.
The validation of an Order using the ordering procedure provided on the Website constitutes acceptance of these T&Cs.
These T&Cs prevail over any other document.

WARNING

The sale of Articles on the Website is strictly reserved for retail sales to private individuals.
Under no circumstances may the Website be used by professional resellers, whether individually or in groups, regardless of the distribution method of their products (e.g., online marketplaces, shopping galleries, intermediaries, physical stores). The Customer acknowledges and accepts that Articles can only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Articles in a single order and the number of individual orders placed for the same product. IM INNOCENTE reserves the right to refuse an order that has been clearly validated by a professional reseller.

The Customer declares they are aware of the lack of reliability of the internet network, especially concerning the security of data transmissions, guaranteed access continuity, performance in terms of data transmission speed and volume, and the potential spread of viruses.
IM INNOCENTE warns each Customer about the importance of implementing security measures on their computer or mobile device to prevent virus spread.

These T&Cs may be subject to modification, and the applicable conditions are those in force on the Website at the time the order is placed.

Defective or non-compliant Articles (replacement or refund) or the exercise of a right of withdrawal cannot be handled directly in IM INNOCENTE's physical stores.
Claims for Articles purchased online must be submitted via the Website.
Similarly, Articles purchased in one of IM INNOCENTE's physical stores cannot be handled via the Website's services.

CHARACTERISTICS OF THE ARTICLES

Articles available for sale are those listed on the Website. Offers remain valid as long as they are visible on the Website.
They are offered within the limits of stock availability displayed on the Website.
IM INNOCENTE reserves the right to remove any Article from sale at any time and/or replace or modify any associated information on the Website.

In the event of the unavailability of an Article after placing an Order, the Customer will be notified by email, and their order will be automatically canceled.
The characteristics of Articles sold on the Website (photographs, graphics, descriptions, etc.) are provided for informational purposes and may vary over time. They are non-contractual.
Only the visual of the Article displayed at the time of the Order should be considered by the Customer.

In the event of errors or omissions in the description of an Article, IM INNOCENTE's liability is limited to reimbursing reasonable return shipping costs incurred by the Customer.

ORDERS FOR ARTICLES
Any Order necessarily requires the Customer's registration or identification via their Customer Account.
The Customer declares to be at least 18 years old and to have legal capacity, or if they are a minor, guarantees that they have parental authorization to place an Order.

To place an Order, the Customer must follow the online purchase process and click on "Order" to submit their Order.
Payment for the Order constitutes acceptance of these T&Cs, the price of the Articles, and the content of the Order.

After payment validation, IM INNOCENTE sends the Customer an email confirming their Order.
Any Order is subject to prior acceptance by IM INNOCENTE and is only definitively confirmed after the Customer receives an email confirming the shipment of the Article(s).

If the Customer does not receive an email after placing their Order, it is their responsibility to contact IM INNOCENTE's customer service via email using the contact form located on the "Contact" page of the website.
IM INNOCENTE cannot be held liable for data entry errors or for the transmission of erroneous data entry that prevents the delivery of the confirmation email and/or the Articles.

It is recommended that the Customer prints the Order confirmation email.
For any questions about the status of an Order, the Customer should contact customer service via email by filling out the contact form located on the "Contact" page of the website, making sure to explicitly include the Order number.


ARTICLE PRICES
Prices are listed on the Website in euros, inclusive of all taxes (TTC), excluding handling and shipping fees.
They reflect any applicable discounts on the date of the Order.
Any new taxes or contributions, including environmental ones, may be added to the sales price of the Articles.

The prices of the Products do not include delivery charges (shipping, packaging, and preparation costs, based on current rates).
Shipping costs are specified on the Website before the Order is finalized.

IM INNOCENTE reserves the right to modify Article prices at any time. However, Articles are invoiced based on the rates in effect at the time of the Order's validation. The price invoiced for the Articles is therefore the one indicated at the time of the Order.

THE ARTICLES REMAIN THE FULL PROPERTY OF IM INNOCENTE UNTIL FULL PAYMENT OF THE PRICE, WHICH THE CUSTOMER RECOGNIZES AND ACCEPTS.


PAYMENT OF THE ORDER
The price charged to the Customer is the price indicated in the Order confirmation email sent to the Customer.
The Order is payable immediately, by bank card (CB, Visa, MasterCard, American Express).

The Customer is informed by email once the Order is shipped, and the invoice, including shipping fees, is available online in their Customer Account.

Transactions carried out on the Website are processed through a secure online payment platform.
These transactions are secured with a solution that offers highly secure pages for entering payment data: card number, expiration date, and CVV.
This platform encrypts and transmits payment data to the bank in complete confidentiality, making them inaccessible to third parties.


DELIVERY TERMS
Articles are delivered worldwide.
Several delivery methods are offered to the Customer at their expense.
Using the shipping number, the Customer can track their package on the carrier's website.

The Customer will receive an email confirming their Order's successful processing, along with notifications of the Order's various stages via email.

Ordered Articles will be delivered within a maximum of 30 days from the Order's registration, subject to full payment. After this period, the Customer has an additional 15 days to contact us to find a solution.

The Customer is responsible for providing all necessary details for the proper routing and delivery of their Order (e.g., access codes, delivery specifications).

Shipments are announced by email to the Customer at the email address provided by them. Therefore, the Customer must provide a valid email address if they wish to be informed of their Order's progress.

If the delivery address provided by the Customer is invalid, resulting in the package's return due to non-delivery at the indicated address, the costs of reshipping the package to the new address provided will be borne by the Customer.

The Customer assumes all risks related to the Articles as soon as they are delivered.

Under customs regulations, any shipment from mainland France to overseas territories or other countries (e.g., Switzerland) and vice versa may require the payment of customs duties upon arrival. Overseas departments and territories (DOM-COM) are not included in the EU's tax area. Therefore, shipments of goods to or from DOM-COM are considered imports or exports and are subject to taxation.

DELIVERY TIMES
Articles are delivered to the address indicated by the Customer at the time of the Order, no later than the date specified during the Order process and depending on the delivery country.

In mainland France, Im Innocente makes every effort to ensure quick delivery. Unless otherwise communicated to Customers through various channels (email, Instagram, etc.), Orders are dispatched within 24 business hours via Colissimo (unless the Customer selects a different option). Colissimo promises delivery within 48 hours. For international shipments, delivery generally takes between 5 and 8 days.

If delivery is delayed by more than 14 business days beyond the stated maximum timeframe, the Customer may contact Im Innocente via email to request the cancellation of their Order within 60 business days.
The contract and the sale will be considered terminated upon receipt by Im Innocente of the email or letter informing them of the Customer's decision, unless the delivery occurs between the dispatch and the receipt of the email or letter.

If the Order is definitively canceled, the Customer will be refunded the amount paid for their Order within 30 days following the cancellation confirmed by email.
In the event the Customer receives the parcel after canceling their Order, Im Innocente will refund the cost of the Articles and the return shipping fees upon receiving the items in their original, perfect condition.

Each delivery is considered completed once the parcel has been handed over to the Customer, as recorded by the carrier’s tracking system.
If the parcel is damaged or if the Article does not match the Customer's Order, the Customer must contact customer service via email to obtain a return authorization within 7 days of receipt.

If the delivery dates for multiple Articles in a single Order differ, the delivery date is based on the latest estimated date.


RETURNS
In case of delivery of an Article that does not match the Customer's Order, is defective due to transportation, or does not meet the Customer's expectations, the Customer may return the Article to Im Innocente. The Customer will bear the return shipping costs.

To qualify for a refund:

  • The Customer must contact Im Innocente within 14 days of receiving the Order.
  • Claims submitted after this period will not be accepted, and Im Innocente will be released from any liability.
  • If the conditions for an exchange or refund are met, Im Innocente will provide the Customer with a return authorization.

The Customer must then return the non-compliant Article(s) within 14 days of receiving the return authorization, in their original packaging, and send them via tracked shipment.

The items must be returned in new condition:

  • With the original tags
  • With the hygiene protection intact
  • Free of stains, odors, or animal hair

Returns or exchanges are not allowed for discounted or sale items.
Any non-compliant return will be rejected, and Im Innocente will be released from any liability.

No prepaid return labels will be issued by Im Innocente.
Shipping costs for returns will only be refunded if the delivered Article is different from what was ordered.

SERVICE CLIENT

AGREEMENT ON EVIDENCE

The Customer acknowledges and accepts that the order recording systems serve as proof of all transactions carried out between IM INNOCENTE and the Customer.
The Customer acknowledges and accepts that acceptance of the Terms and Conditions is evidenced by ticking the box - I have read and accept the general terms and conditions of sale.
To this end, the Customer acknowledges and agrees that computerized data stored on IM INNOCENTE's servers under reasonable security and integrity conditions shall be considered irrefutably as proof of the acceptance of the Terms and Conditions and proof of all transactions conducted between IM INNOCENTE and the Customer.

IM INNOCENTE will archive order confirmations and invoices on reliable and durable media, in accordance with the provisions of Article 1348 of the French Civil Code, and guarantees access to them by the Customer upon request, pursuant to Article L. 134-2 of the French Consumer Code.

Consequently, except in cases of manifest error by IM INNOCENTE proven by the Customer, the latter cannot contest the admissibility, validity, or evidentiary value of the Terms and Conditions or the content of the Order based on any legal provision requiring certain documents to be written or signed to constitute proof.

These elements thus constitute evidence, and if presented as proof by IM INNOCENTE in any contentious or other procedure, they will be admissible, valid, and enforceable in the same way, under the same conditions, and with the same evidentiary force as any document created, received, or kept in writing.

The Customer may at any time print, download, and retain a copy of the Terms and Conditions on paper or electronic media.


RESPONSIBILITY

IM INNOCENTE reserves the right to modify the information contained on this website at any time and without prior notice.

IM INNOCENTE is committed to describing the products sold on the website as accurately as possible and to ensuring, to the best of its ability, the updating of the information disseminated.

However, IM INNOCENTE cannot guarantee the accuracy, precision, or completeness of the information provided to Customers on the website.

In the event of non-substantial differences between the presentation photos, texts, or illustrations of the products on the website and the products delivered, IM INNOCENTE's liability will not be engaged.

The Customer acknowledges and accepts that product prices may vary between the website and physical stores and that under no circumstances shall this price difference justify a request for a full or partial refund for items purchased either on the website or in stores.

IM INNOCENTE shall not be held responsible for any failure to fulfill one of its contractual obligations due to a fortuitous event or force majeure as defined by French jurisprudence.

Specifically, IM INNOCENTE will not be held responsible for any non-performance or delay in the execution of Orders caused by events beyond its control ("Force Majeure").
Force Majeure events include any act, event, non-performance, omission, or accident beyond IM INNOCENTE's control, including but not limited to:

  1. Strikes, lockouts, or other industrial actions.
  2. Civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, wars (declared or not), or threats or preparations for war.
    1. Fires, explosions, storms, floods, earthquakes, subsidence, epidemics, or other natural disasters.
    2. Inability to use railways, ships, planes, roads, or other private or public transportation means.
    3. Inability to use public or private telecommunications networks.
    4. Acts, decrees, laws, regulations, or restrictions by any government.
    5. Strikes, failures, or accidents in maritime, postal, or other forms of transportation.

    The performance of the Terms and Conditions will be suspended for as long as the Force Majeure event lasts, and execution and delivery deadlines will be extended accordingly. IM INNOCENTE will endeavor to mitigate the Force Majeure event or find a solution to fulfill its contractual obligations despite it.

    IM INNOCENTE is solely responsible for any direct and foreseeable damage at the time of using the website or concluding the sales contract with the Customer, excluding any indirect damage.

    LICENSE

    IM INNOCENTE grants a limited license to access and use the website for personal, non-professional, and non-commercial purposes by the Customer.
    Under no circumstances is the Customer authorized to download or modify any part of this website without the explicit written permission of IM INNOCENTE.

    This website or any part thereof must not, under any circumstances, be reproduced, copied, sold, or exploited for commercial or professional purposes without the explicit written consent of IM INNOCENTE.

    The Customer must not use techniques to copy a trademark, logo, or any other proprietary information (including images, text, or layouts) owned by IM INNOCENTE without its explicit written consent.

    IM INNOCENTE allows the Customer, on a non-exclusive and revocable basis, to create a hyperlink pointing to the homepage of the website, provided that this link does not create a misleading, false, derogatory, counterfeit, or harmful perception of the products, IM INNOCENTE, or any of its registered trademarks.

    Under no circumstances will the creation of such a hyperlink engage the liability of IM INNOCENTE in any way.


    PERSONAL DATA PROTECTION

    The personal data collected on the website is intended for IM INNOCENTE with the Customer's consent.
    IM INNOCENTE is committed to protecting its Customers' personal data.
    All personal data collected by IM INNOCENTE is handled with the utmost confidentiality, in accordance with the provisions of Law 78-17 of January 6, 1978, concerning Data Processing, Files, and Freedoms, for the purposes of processing orders.

    Customer information and personal data are necessary for order management, customer relations, and keeping customers informed about offers and commercial information that may interest them.
    These data may be transmitted to service providers and contractual partners involved in and contributing to order management.

    This information and order management data are also retained for security purposes, to comply with legal and regulatory obligations, and to enable IM INNOCENTE to improve and personalize the services offered to Customers.

    Pursuant to the French Data Protection Act of January 6, 1978, the Customer has the right to access, rectify, and oppose the processing of their personal data.

    To exercise this right, the Customer must send an email or letter to IM INNOCENTE's Customer Service by completing the contact form available on the website or writing to the following address:

    Each request must be signed and accompanied by a photocopy of an identity document bearing the Customer's signature and specify the address for the reply. A response will be sent within two months of receiving the request.

    In accordance with current legislation, such information will only be sent to the Customer if they have expressly agreed to receive it.
